Commodity Price Regulation on JD.HK Open Platform
Chapter I Definition
1.1 JD price: it refers to the price set by merchants for goods selling on JD.HK Open Platform.
1.2 Price fraud: it refers to the practice that merchants use false or misleading price means to lure consumers into trading with them.
1.3 Original price of the promotional goods: it refers to the lowest transaction price traded by the merchant on JD.HK Open Platform with transaction note within seven days before the promotion; If there is no transaction within the previous 7 days, the last transaction price before this promotion will be the original price.
1.4 False original price: it refers to the false original price marked by the merchant in the promotion activities, and the transaction record of the commodity at the original price does not exist or the commodity has never been traded.
1.5 False discount price: it refers to the pre-discount price or the price calculated by the actual transaction price and discount range higher than the original price marked by the merchant in the promotional activities.
1.6 Price commitment: it refers to a specific commitment made by the merchant to the commodity price or service by means of commercial advertisement, commodity description, sales promotion, physical sample, notice, declaration, store notice, etc.
1.7 SKU: the full name is stock keeping unit, which is the smallest available unit for keeping inventory control. Each product on the JD.HK Open Platform has a SKU, which is convenient for the e-commerce brand to identify the product. A product with multiple colors has multiple SKUs. For example, a piece of clothing with red, white and blue colors has different SKU codes.
Chapter II Pricing Specification
2.1 Merchants agree that the JD price of the same commodity (with the same style, model, color, etc.) or service should not be higher than the offline sales price of the brand (offline sales price includes counter price, tag price or suggested retail price, etc.), and the normal selling price of the brand on its official website, its own e-commerce platform and other platforms, except with the approval of JD.HK Open Platform.
2.2 For commodities with government-set or guided prices, the JD price should be subject to the government-set or guided prices. The price should not be altered or exceed the fluctuation range.
2.3 The price description of the product should be true, accurate and factual. The price description of the single product and the special event should comply with the Specification for Commodity Information Release on JD.HK Open Platform. The selling price should be subject to the JD price displayed on the website of JD.HK. The information of single commodity should contain the labeled price, and the JD price in the commodity details page should be consistent with the labeled price.
2.4 Before participating in the promotional activities on JD.HK Open Platform, merchants are not allowed to raise the price (including the activity price and JD price) at will, except in the case of market price fluctuation, which should be subject to the verification of JD.HK Open Platform. If the merchant violates this provision, JD.HK Open Platform has the right to restrict the merchant from participating in the promotional activities on JD.HK Open Platform.
2.5 Other list price behaviors of merchants
2.5.1 When the merchant conducts sales promotion activities by comparing prices with those of other business operators or other forms of sales, the meaning of the prices being compared should be clearly indicated and it can be demonstrated that the labeled price being compared is true and justified.
2.5.2 When the merchant conducts sales promotion activities by presenting goods or services, etc, If the price (value) of the presented goods or service is marked, the marked price (value) should be true and clear.
2.5.3 When the merchant conducts sales promotion activities by returning valuable coupon or points rebateand other ways, and if the use conditions of valuable coupon or points rebate are attached but not clearly marked in the prominent position of the coupon or business location, it should be price violations.
Chapter III Price Violation
3.1 The merchant must strictly abide by Pricing Law of the People's Republic of China, Law of the People's Republic of China Against Unfair Competition, Regulation Prohibiting Price Fraud and other relevant laws and regulations, and follow the market rules, to ensure that a legal basis or a source for comparison for any price can be provided. There should be no deceptive price marking or any acts suspected of price fraud, including but not limited to the following price violations:
3.1.1 Commodity release in unconventional quantities
It refers to release commodity by splitting the normal specification, such as: the normal specification of paper tissue is the unit of "bag", but the merchant splits it into the unit of "piece" for sales; The normal specification of curtain is the unit of "meter", but the merchant splits it into the unit of "millimeter" for sales.
3.1.2 Commodity postage deviating from the actual price
When releasing physical goods, the postage price of the goods is obviously not matched with the price of the goods on sale and does not conform to the postage industry standard, or the virtual goods have postage.
For example 1: The price of a piece of clothing is set at RMB 2, and the postage price is set at RMB 53.
For example 2: A member published a commodity of Zhejiang Mobile RMB 100 online recharge in the store, and marked "This commodity needs RMB 5 postage." in the commodity information.
Chapter IV Management on Price Violation
4.1 If the commodity price is found to be illegal, JD.HK Open Platform has the right to deal with the merchants according to the general violation of "commodity price violation" in the Credit Management Rules for Merchant of JD.HK Open Platform.
4.2 JD.HK Open Platform will irregularly check and supervise the JD price of the goods in shop marked by the merchant. If the price marking is found to be illegal, the merchant should bear the corresponding liability for breach of contract. And JD.HK Open Platform has the right to deal with the merchants according to the general violation of "commodity price violation" in the Credit Management Rules for Merchant of JD.HK Open Platform.
Chapter V Supplementary Provisions
5.1 Any conduct of the merchant of JD.HK Open Platform, which happened before the effective date of the Management Rules, shall be subject to the rules effective at that time. Any such conduct arising after the effective date of the Management Rules, the Rules shall govern.
5.2 JD.HK Open Platform may adjust the management rules from time to time according to the platform operation and disclose such adjustments to the merchants through the announcement on JD.HK Open Platform. By settling on JD.HK Open Platform, the merchants acknowledge that they accept the Management Rules that will be adjusted and issued from time to time.
5.3 The merchant shall comply with national laws, administrative regulations, rules of authorities and other normative documents. The Rules shall be applicable to any alleged breach of national laws, administrative regulations, rules of authorities and normative documents, if such breach is stipulated therein. Any matter left unmentioned in the Rules shall be handled by JD.HK Open Platform at its discretion. But JD.HK Open Platform's handling of the merchants does not exempt them from the legal liability they should bear. Any conduct of the merchants on JD.HK Open Platform shall also be subject to the agreements signed with JD.HK and its affiliates; Any default shall be deemed as a breach of the Rules.
5.4 The Rules were released on December 21, 2018 and took effect on December 28, 2018.
